​@Hope is life As nothing was mentioned as to which tax rate scheme you would be opting for, i did not include basic exemption in that calculation. If suppose you follow old regime with enhanced basic exemption that tax comes out to be :

Possibility 1 : 6,00,000-3,00,000 = 3,00,000 x 15% = 45,000 less rebate of 25,000 = 20,000

Possibility 2 : 6,00,000 - 3,00,000 = 3,00,000 less 1 lakh = 2,00,000 at 10% = 20,000

​@Hope is life Revised calculation given by @MuStrFc is correct provided there is no other income except above mentioned 6 lakh. @mustrfc has written old regime it may be read as new tax regime. I am neither CA nor a tax expert. Once u opt for new tax regime and if u have business income (not sure about STCG etc) there are restrictions on opting back for old tax regime in future. Perhaps it is not allowed or allowed only once.

​@Hope is life If insted of STCG u show it as business income then even 7.50 L would be tax free. I mean 7.50 l gross business income and 50k expenses. Under new tax regime. Instead of 7.50 L it could also be 7.70 l if you show 70k as expenses regarding this please consult some tax expert. Please also see my previous message regarding restriction on reverting back to old tax regime. Most of the exemptions are not allowed under new tax regime

​@Hope is life Income tax Department doesn't like frequent changes. If you show as business profit this fy and next fy u show as STCG and next to next fy u show as business income then it may be objected to by income tax Department. Please consult some tax expert for more on this issue. If you are doing frequent trading say your average holding period is less than 2 or 3 weeks then it is business income, u can't show it as STCG. If you are selling most of allotted IPO s on listing day itself then it is business income and not STCG. If you doing only share trading and not doing any other job or business then it is business income and not STCG.

​@PUSHPaa Ji, A better way will be apply IPO though HUF of your father, because as your father is Govt Employee, I presume that he will be in 20% /30 % tax bracket, so income from shares (STCG) here will be taxable flat @ 15 % without any reabte/ initial exemption limit u/s 111A .
But in case of HUF ,if HUF is not having any other income besides IPO income , your father very well use the initial exemption of 3 LAKH , means upto 3 lakhs profit from IPO there will not be any income tax

​@PUSHPaa No need to worry. Apply in IPOs, if got allotment he can sell it on listing day or after that any time. If your father is Govt servant/officer, he can apply and on allotment, he can sell it on the same day. Only he is liable to pay Income tax if his total income from all sources is more than income tax limit. If he is in the higher slab of income still he is liable to pay only, I repeat liable to pay only 15% on his Short Term Capital Gains. Show this in income from other sources. If he sells after 1 year, he need not pay upto the income of 1 lakhs. As it is long term capital gains. But to show every thing in ITR.
Your father can consult his tax consultant through whom he is filling his ITR.
For sound sleep never hide any income from IT Department because they know all our financial transactions.
I am also a retired Govt Officer.
Earn from any official source but pay tax if it is required.

Govt employees are not allowed to do short term trading. They are allowed to do long term investment. If a Govt employee applies for ipo and gets allotment and hold shares for long term then ok. Taking loan for applying in IPO or buying shares is not allowed. These are conduct rules of Govt employees. Employer (Department) will have objection. Income tax department will not have any objection if tax is paid. These restrictions are not applicable to retired employees.

Your question is very orthodox. A person having 6lakhs STCG and no other income from Bank as interest. No share dividend, etc.
According to your question only, he will not be liable to pay income tax in new rules (limit 7lakhs).
If I am wrong, I may please be corrected. Enhance my knowledge of income tax rules as not well versed in IT.

​@investormahesh , restriction is there in intraday trading. No restriction in booking short term profit in positional play. Common sense is that if a govt employee do intraday trading than when will he work. So intraday trading is restricted but positional you can bet on

Govt. employees apply in IPOs, get allotment and sell on the very first day of listing, he is not at fault and not against the code of conduct. . But no enquiry from employer about STCG. To show in ITR. Now income upto 7.5 lakhs for employees there is no tax. (7 lakhs + 50,000 standard deduction). I am a retired Govt. employee and investing in Share Market from more than 40 years. Dear are you a Govt. employee or any body in your circle has faced this problem.
STCG is there, where one has to pay tax of 15% subject to conditions. You can confirm the facts from I T Consultant.

@papon I am very sure about what I have replied. If u sell shares of a company and use that money to buy shares of another company company and do it few times every year it is not allowed. Similarly if you sell ipo allotment within few weeks and use proceeds to apply in next ipo it is not allowed. The idea is Govt employee mind should focus on his work and not on share market. Many employees do positional trading but their boss ignores it doesn't mean it is allowed. Many employees come late to office or do part time private job and their boss ignores it doesn't mean it is allowed. Govt policy is that employee may invest in share market directly or through mutual fund but sell it when he needs money for buying house, children marriage, children education etc.

​@PKRAJ If a Govt employee comes late to office daily for many years and his boss ignores it doesn't mean late coming is allowed. Regarding share market trading it is possible that boss may even not come to know. If u invest in share market but had to sell shares after 3 months due to illness of some dependent it is certainly allowed and u may have made STCG. Illness is only one example. There can be several other reasons where you need money. If you sell shares with a view to buy shares of another company it is okay once in a while but not frequently. Conduct rules clearly state that speculation in shares is not allowed. Doing part time private job along with regular Govt job is not allowed even if you are paying income tax on salary of private job. I have already stated that these restrictions are not applicable to retired employees even if they are getting pension.

You are eligible for rebate under sec 87A . So ,no tax is required to be paid unless there is any LTCG above one lac. Actually sec 111A (STCG) eligible under sec 87A but not 112A (LTCG).

You have correctly understand what I have meant.
Actually ,first basic exemption upto 3 lac , then coverage of sec 87A upto seven lac.
Sec 87A doesn't include some items where there is specific rates like that in lottery ,online gaming, gaming and similar income etc .It excludes HUF income and also income under sec 112A under which LTCG comes.
So , you can't evade tax on income from LTCG above one lac.

Dear Members who participated regarding taxes on STCG, LTCG and other for salaried persons in Govt. as a basic question, it is difficult to arrive at one point. We may search all these points in IT Rules for the current f y.
In my opinion, every member should take opinion from his/her personal tax advisor who have any doubt. I am not competent to join this discussion any more. Our time was different than the present. Gone are the days.

Transactions in the Shsres in respect of Government employees are governed by CCS(Conduct) Rules.

Limits have specified in the Rules, Transaction wise as well Year wise, and in case limits exceed, intimation is to be given to Head of the Office/Head of department.

Limits vary depending on the cadre or the employee.

Transactions should not be in nature of trade.

Intra day trade, which amounts to, speculative Transaction, is totally against conduct Rules.

As long as Transactions are confined to IPO and sold on listing, such transactions are well within the Rules.

Secondary market purchases can also be permitted, if such shares are taken delivery and held for some time.

However, the proceedings under Income tax act are totally different, and taxes have to be paid, wherever applicable.

Dear senior members...how can we infuse capital in huf A/c? I think if karta or any coparcener transfer capital and if capital gain arise from that capital it will be taxable in the hand who transfer capital. I am not sure this.

It will be helpful for tax exemptions like rental incomes, share market income on that Huf. It also increases allotment chances because of 2 pan cards (1 Huf & another personal pan card)

HUF can infuse capital only through Gifts from Relative and Non-Relative. Any gift from Relative is tax free. the only criteria is that they should have enough taxable income to gift you. Definition of Relative -
a. Spouse of the individual;
b. Brother or sister of the individual;
c. Brother or sister of the spouse of the individual;
d. Brother or sister of either of the parents of the individual;
e. Any lineal ascendant or descendent of the individual;
f. Any lineal ascendant or descendent of the spouse of the individual;
g. Spouse of the persons referred to in (b) to (f).

If you get gift from Non relative, it is taxable in normal tax bracket.

Karta or any of the member cannot infuse capital to HUF.

​@Monisha I fear there may be some ifs and buts and it won’t be as simple as you are saying. I am not CA; you are the one, and I am not doubting your command of your domain. However, I seek more clarity. Say, any govt employee transfers all his IPO allotted holding to his HUF via offline transfer and then sells from HUF. It is a clear way to avoid the taxes. Now coming to your answer. It is a legalized way to save the tax, if I am not interpreting wrong. Is that the same you want to say, kindly explain.

​@Nifty Singh I think your doubt is also right. Can huf buy shares through offmarket from karta at lower price and then sell at higher price in the market.In this situation capital gain of karta can be negative or zero and that gain will reflect in huf a/c.

Select yes in opting 115BAC, and then fill up figures in STCG 111A and LTCG 112A(If shares sold after 12 months)

It will calculate your tax liability
NOTE: It will give you only basic idea about it , for detailed understanding you have to attend the seminar of almost 5-6 hours.

HUF is a non individual entity. any amount above rs 50000 received from any one is fully taxable in the hands of the HUF. MEMBERS of the HUF if infuse capital in HUF & if this sum generates any income then its taxed to the member & not HUF.
Funding of huf is a bit tricky. it can take gifts but huf have to pay taxes above 50000 rs.

Want to clarify one thing, as a govt employee can a person open huf and do short term trades? I am central government employee and I was thinking to open huf. Can a government employee become karta in huf and do investment, ipo and short term trades ?

Govt employee cannot do short term trades, employer does not like it and likewise the govt. The can do delivery trades and IPO application and selling on listing, intraday is not allowed.

Now, to turn things, say the government employee opens up a HUF to do all the above which he cannot do in personal capacity. That is also not allowed as clubbing provisions get attracted.

So, say if a govt employee or any person opens a HUF and transfers shares using off market transaction as GIFT, general consensus is HUF and that person are relative so GIFT IS EXEMPTED but due to clubbing provisions the capital gains on sales of shares as per holding period will be clubbed in the hands of other person, so the person is liable to pay one way or another.

Hence, its better to not speculate on such practices, ONE CAN OPEN HUF to increase chances of allotment due to separate PAN, but transfer in the end will be taxable one way or another. Feel free to comment and question.

I beg to revert. Dar bhi lag raha he , koi spam bolega ki kya bolega.
I know that @ MuStrFc is a knowledgeable person and he has rightfully calculate a tax of 20000 in the case no 1.
But there are some points beyond that.
1.Income from the day trading is treated as a business income and tax is chargeable as per applicable rate.
2. The Income tax department can nullify STGC in entirety and force it under business income if frequent trades are found and purpose of buying is similar to the case of trading .
3. There is questionable space between the business assumption and capital gain
4. However, if the tax payer wants to treat STCG as stock in trade, the gain will be considered as business income .
5. Moreover In this particular case , as the person has no other income , the income from here may be rightfully taken as his means of livelihood and thereby treated as a business income .
6. Once it comes under business income, no tax is chargeable as 15% Stcg will be reduced to 5% and 10% repectably and rebate under sec 87A will remain within the limit.
7.There are many other relevent points in this subject.

Everyone knows, these are very important discussions, great information, nice contribution as people spent valuable time to reply etc.. but assume same question comes to different IPO page by new user OR the user who didn't read this OR old user then what will you do? how will you search? will you roam around in all ipo pages? good to answer again and duplicate everything? I say to government employees avoid to apply IPO and investment in stock it against department rules.

gift deed is require when you have immovable property transferred to HUF. If the gift is through bank transfer then you dont need any gift deed. The only criteria is relative should have sufficient income (filed in his income tax return) to prove his source of money if there is any question from IT dept. It cannot be someone not filing income tax and giving a gift of 1 Cr.

No govt stop to invest, all it wants to not engage in any bussiness. So Indraday, fno are no, but anyone can invest for st or lt.
